HENRY WEINNECKE,

a witness called and sworn on behalf of the People, was examined in chief by Mr. Walker and testified as follows:

Q You have already testified?

A Yes sir.

Q Where were you in Lieut. Steele's Company on May 4th?

A The first Company, No. 6.

Q Were you in the front row?

A The front row, yes sir.

Q Did you have anything shining in your hand, either pistol or revolver, before the bomb exploded.

Objected to as not proper rebutting testimony. The court overruled the objection; to which ruling of the court counsel for defendants then and there excepted.

A No sir.

Q Who was at your left?

A Bauman.
