MAGGIE NEEBE,

a witness called and sworn on behalf of the defendants, was examined in chief by Mr. Foster and testified as follows:-

Q- What is your name?

A- Maggie Neebe.

MR. INGHAM;- We object to her testifying.

MR. FOSTER: Q- Where do you live?

A- We live at 272 West 12th. street.

Q- When did you move to 272 West 12th. street?

MR. INGHAM: We object to her testifying in the case.

THE COURT; She is competent as to every thing except anything that effects her husband. It wont be claimed she can testify to anything affecting him.

MR. BLACK: No she can not be called for him.

Mr. FOSTER. Q- Are you a wife of Oscar Neebe?

A- Yes sir.

Q- How long have you been his wife?

A- About 14 years.

Q- Have you any children?

A- Yes sir.

Q- How many?

A- Three.

Q- I will ask you whether you have in your house a red flag?

Objected to. Objection sustained; to which ruling of the court counsel for defendants then and there duly excepted.

Q- I will ask you whether you have had and did have for a month prior to the 4th. of May and on the 4th. of May, the possession of a revolver?
