come, and on motion of said States Attorney it is ordered by the Court, that this cause be, and the same is hereby set for trial on Monday June twenty-first A.D.1886

Thereupon it is ordered that the said defendants except Oscar W.Neebe be remanded into the custody of the Sheriff of Cook County.

This day again come the said People by Julius S. Grinnell, States Attorney and the said defendants as well in their own proper persons as by their aforesaid Counsel also come, and the said defendants by their Counsel now here move the Court for leave to withdraw their ploa of Not Guilty heretofore rendered to the Indictment in this cause, and the Court hearing Counsel in support of said motion as well as in opposition thereto, and being now fully advised in the premises doth overrule said motion and orders that said motion of said defendants for leave to withdraw their plea of Not Guilty be and the same is hereby overruled accordingly.

This day come the said People by Julius S. Grinnell, States Attorney and the said defendant as well in his own proper person as by Salomon and Zeisler; W. P. Black and W. A. Foster his Counsel also comes, and he having been furnished with a copy of the Indictment in this cause and lists of the names of the witnesses and Jurors and he being now here duly araigned and forthwith demanded of and concerning the crime alleged against him in said Indictment how he will acquit him-self thereof for a plea in that behalf says that he is Not Guilty in manner and form as charged therein, and of this he puts himself upon the Country and the said People do the like.

And the said defendant by his Counsel now here moves the Court for leave to withdraw his plea of Not Guilty entered herein, and the Court hearing Counsel in support of said motion as well as in opposition thereto, and being now fully advised in the premises doth overrule said motion and orders that said motion of said defendant for leave to withdraw his plea of Not Guilty be, and the same is hereby overruled accordingly.

This day again come the said People by Julius S. Grinnell States Attorney and the said defendants as well in their own proper persons as by their aforesaid Counsel also come.

And now issue being joined it is ordered that a Jury come, whereupon Counsel proceed with the examination of Jurors, and the regular panel of Petit Jurors having been exhausted.

Thereupon it is ordered by the Court that three special Venires for twenty five men each issue out of this Court commanding the Sheriff of Cook County to summon seventy five good and lawful men from the body of Cook County to appear before this Court at the hour of ten o'clock tomorrow morning and from whom to select a Jury for the trial of this cause, and the hour of adjournment having arrived it is ordered that the further selection of a Jury and consideration of this cause be and the same is hereby postponed until the coming in and opening of this court at ten o'clock tomorrow morning, and that in the meantime the said defendants August Spies, Michael Schwab, Samuel Fielden, Albert R. Parsons, Adolph Fischer, George Engel, and Louis Lingg be remanded into the custody of the Sheriff of Cook County.

This day again come the said People by Julius S. Grinnell, States Attorney and the said defendants as well in their own proper persons as by their aforesaid counsel also come, and the Sheriff of Cook County having returned into Court the three special Venires issued yesterday, Counsel proceed with the further examination of Jurors, and J. H. Cole, S. G. Randall, T. E. Denker and C. B. Todd having been selected were sworn to try this cause, where upon it is ordered by the Court that three special Venires for twenty-five men each issue out of this Court commanding the Sheriff of Cook County to summon seventy-five good and lawful men from the body of Cook County to appear before this Court at the hour of ten o'clock to-morrow morning, and the hour of adjournment having arrived it is ordered that the further selection of a Jury and consideration of this cause be and the same is hereby postponed until the coming in and opening of this Court at ten o'clock to-morrow morning, and that in the meantime the four jurors aforesaid remain in the custody of two sworn officers of this Court to be by them kept together and returned into Court at the hour last aforesaid.

This day again come the said People by Julius S.Grinnell States Attorney and the said defendants as well in their own proper persons as by their aforesaid Counsel also come, and also come the four Jurors selected and sworn herein, Counsel proceed with the further examination of jurors, whereupon it is ordered by the Court that three special Venires each for fifty Petit Jurors issue, one returnable at ten o'clock to-morrow morning, one returnable at two o'clock tomorrow afternoon, and one returnable at ten o'clock Thursday morning July first A.D.1886.

And now upon objection by Counsel for defendants, to the Sheriff summoning said Jurors, it is ordered by the Court that Henry L.Ryce be, and he is hereby appointed a Special Bailiff

Grinnell, States Attorney and the said defendants as well in their own proper persons as by their aforesaid Counsel also come, Counsel proceed with the further examination of Jurors and the hour of adjournment having arrived it is ordered that the further examination of Jurors and trial of this cause be and the same is hereby continued until the first day of the next term of this Court Monday July fifth A.D. 1886, and that in the meantime the four Jurors aforesaid, and the Jurors under examination remain in the custody of two sworn officers of this Court to be by them kept together and returned into Court at the coming in and opening thereof on the said first day of the next term of this Court.

Grinnell, States Attorney and the said defendants as well in their own proper persons as by their aforesaid Counsel also come, and also come the Jurors of the Jury aforesaid, and the aforesaid Jury hearing the further arguments of Counsel and instructions of the Court, retire in charge of three sworn officers to consider of their verdict.

Grinnell, States Attorney and the said defendants as well in their own proper persons as by their aforesaid Counsel also come, and the aforesaid Jury being now returned into Court by the Officers having them in charge for a Verdict say: "We the Jury find the defendants, August Spies, Michael Schwab, Samuel Fielden, Albert R. Parsons, Adolph Fischer, George Engel and Louis Lingg Guilty of Murder in manner and form as charged in the Indictment and fix the penalty at Death, we find the defendant Oscar W. Neebe Guilty of Murder in manner and form as charged in the Indictment and fix the penalty at imprisonment in the Penitentiary for fifteen years."

And the said defendants by their Counsel now here demand that the Jury be polled, and the Jurors of the Jury aforesaid being separately called and demanded whether the above Verdict by him rendered was and is now his Verdict, each for himself

answering says, that the above Verdict was and is now his Verdict, whereupon it is ordered that the said Verdict be received and entered of Record, which is done.

And the said defendants by their Counsel now here move the Court for a New Trial in this cause, and by agreement between the said States Attorney, and the said defendants and their aforesaid Counsel now here given and made in open Court it is ordered that the hearing of the motion for a New Trial in this cause be, and the same is hereby continued until the next term of this Court.

Thereupon it is ordered, that the said defendants be remanded into the custody of the Sheriff of Cook County.

And the said defendants by their Counsel now here move the Court in Arrest of Judgment in this cause, and the Court hearing Counsel in support of said motion, as well as in opposition thereto, and being now fully advised in the premises, doth overrule said motion and orders that said motion in arrest of Judgment in this cause be, and the same is hereby overruled accordingly, to which order of the Court in overruling said motion the said defendants by their Counsel now here except.
