Charged with making an unlawful, willful, felonious and with malice aforethought assault on the body of Mathias J. Degan causing him mortal wounds, bruises, lacerations and contusions upon his body.

Of the May Term of the Criminal Court of Cook County, in said County and State, is the year of our Lord one thousand eight hundred and eighty-six.

The Grand Jurors chosen, selected and sworn, in and for the county of Cook in the State of Illinois, in the name and by the authority of the People of the State of Illinois, upon their oaths present that one August Spies one Michael Schwab one Samuel Fielden one Albert R. Parsons one Adolph Fischer one George Engel one Louis Lingg one William Seliger one Rudolph Schnaubelt and one Oscar W. Neebe, each late of the county of Cook, on the fourth day of May, in the year of our Lord one thousand eight hundred and eighty-six, in said county of Cook in the State of Illinois aforesaid, in and upon the body of one Matthias J. Degan, in the peace of the said People of the State of Illinois then and there being, unlawfully, wilfully, feloniously and of their malice aforethought, did make an assault, and that they the said August Spies the said Michael Schwab the said Samuel Fielden the said Albert R. Parsons the said Adolph Fischer the said George Engel the said Louis Lingg the said William Seliger the said Rudolph Schnaubelt and the said Oscar W. Neebe, with a certain deadly and destructive instrument then and there charged with divers dangerous and explosive substances, a more particular description of which is to the said jurors unknown, unlawfully, wilfully, feloniously and of their malice aforethought did ignite and cast upon the ground near to the said Matthias J. Degan then and there causing the said instrument to explode and fragments thereof to strike, lacerate, penetrate and wound the body and limbs of the said Matthias J. Degan, then and there giving to him, the said Matthias J. Degan, with the fragments aforesaid in and upon divers parts of the head, left thigh, limbs and body of him, the said Matthias J. Degan, divers mortal wounds, bruises, lacerations and contusions, of which said mortal wounds, bruises, lacerations and contusions he, the said Matthias J. Degan from the said fourth day of May, in the year aforesaid, until afterwards, to wit, on the same fourth day of May, in the same year, languished and languishing did live, on which said fourth day of May, in the same year, in the county and state aforesaid, he, the said Matthias J. Degan, of the said mortal wounds, contusions and lacerations died, and so the jurors aforesaid, upon their oaths aforesaid, do say that the said August Spies the said Michael Schwab the said Samuel Fielden the said Albert R. Parsons the said Adolph Fischer the said George Engel the said Louis Lingg the said William Seliger the said Rudolph Schnaubelt and the said Oscar W. Neebe him, the said Matthias J. Degan, in manner and form aforesaid, unlawfully, wilfully, feloniously and of their malice aforethought, did kill and murder, contrary to the statute, and against the peace and dignity of the same People of the State of Illinois.

The Grand Jurors aforesaid, chosen, selected and sworn, in and for the county of Cook in the State of Illinois, in the name and by the authority of the People of the State of Illinois, upon their oaths aforesaid, do further present that one August Spies one Michael Schwab one Samuel Fielden one Albert R. Parsons one Adolph Fischer one George Engel one Louis Lingg one William Seliger one Rudolph Schnaubelt and one Oscar W. Neebe, each late of the county of Cook, on the fourth day of May, in the year of our Lord one thousand eight hundred and eighty-six, in said county of Cook, in the State of Illinois aforesaid, in and upon the body of one Matthias J. Degan, in the peace of the said People of the said State of Illinois then and there being, unlawfully, wilfully, feloniously and of their malice aforethought, did make an assault, and that they the said August Spies the said Michael Schwab the said Samuel Fielden the said Albert R. Parsons the said Adolph Fischer the said George Engel the said Louis Lingg the said William Seliger the said Rudolph Schnaubelt and the said Oscar W. Neebe, with a certain pistol, commonly called revolver, then and there charged with gunpowder and divers leaden bullets, which said pistol they the said August Spies the said Michael Schwab the said Samuel Fielden the said Albert R. Parsons the said Adolph Fischer the said George Engel the said Louis Lingg the said William Seliger the said Rudolph Schnaubelt and the said Oscar W. Neebe, then and there in their several and respective right hands had and held him the said Matthias J. Degan, in and upon the left thigh of him, the said Matthias J. Degan, then and there unlawfully, wilfully, feloniously and of their malice aforethought, did discharge and shoot off to, against, towards and upon the said Matthias J. Degan, and that the said August Spies the said Michael Schwab the said Samuel Fielden the said Albert R. Parsons the said Adolph Fischer the said George Engel the said Louis Lingg the said William Seliger the said Rudolph Schnaubelt and the said Oscar W. Neebe, with one of the leaden bullets aforesaid, out of the pistol aforesaid, then and there by force of the gunpowder aforesaid, by the said August Spies the said Michael Schwab the said Samuel Fielden the said Albert R. Parsons the said Adolph Fischer the said George Engel the said Louis Lingg the said William Seliger the said Rudolph Schnaubelt and the said Oscar W. Neebe discharged and shot off as aforesaid, then and there unlawfully, wilfully, feloniously and of their malice aforethought did strike, penetrate and wound him, the said Matthias J. Degan, in and upon the left thigh of him, the said Matthias J. Degan, giving to him, the said Matthias J. Degan, then and there with the leaden bullet aforesaid, so as aforesaid discharged and shot out of the pistol aforesaid by the said August Spies the said Michael Schwab the said Samuel Fielden the said Albert R. Parsons the said Adolph Fischer the said George Engel the said Louis Lingg the said William Seliger the said Rudolph Schnaubelt and the said Oscar W. Neebe, in and upon the left thigh of him, the said Matthias J. Degan, one mortal wound, contusion and laceration, of the depth of four inches and of the breadth of one inch, of which said mortal wound, contusion and laceration he, the said Matthias J. Degan, from the said fourth day of May in the year aforesaid, until afterwards, to wit, on the same fourth day of May in the same year, languished and languishing did live, on which said fourth day of May in the same year, in the county and state aforesaid, he, the said Matthias J. Degan, of the said mortal wound, contusion and laceration died, and so the jurors aforesaid, upon their oaths aforesaid, do say that the said August Spies the said Michael Schwab the said Samuel Fielden the said Albert R. The Grand Jurors aforesaid, chosen, selected and sworn, in and for the county of Cook, in the State of Illinois, in the name and by the authority of the People of the State of Illinois, upon their oaths aforesaid, do further present that one certain person, a further description of whom is to the said jurors unknown, late of the county of Cook, on the fourth day of May, in the year of our Lord one thousand eight hundred and eighty-six, in said county of Cook in the State of Illinois aforesaid, in and upon the body of one Mathias J. Degan, in the peace of the said People of the State of Illinois then and there being, unlawfully, wilfully, feloniously and of his malice aforethought, did make an assault, and that he, the said certain person, a further description of whom is to the said jurors unknown, with certain means, instruments and weapons, a more particular description of which is to the said jurors unknown, unlawfully, wilfully, feloniously and of his malice aforethought did strike, lacerate, penetrate and wound the body and limbs of the said Matthias J. Degan, then and there giving to him, the said Matthias J. Degan, with the means, instruments and weapons aforesaid in and upon divers parts of the head, left thigh, limbs and body of him, the said Matthias J. Degan, divers mortal wounds, bruises, lacerations, and contusions, of which said mortal wounds, bruises, lacerations, and contusions he, the said Matthias J. Degan, from the said fourth day of May, in the year aforesaid, until afterwards, to wit, on the same fourth day of May, in the same year, languished and languishing did live, on which said fourth day of May, in the same year, in the county and state aforesaid, he, the said Matthias J. Degan, of the said mortal wounds, contusions and lacerations died, and that one August Spies one Michael Schwab one Samuel Fielden one Albert R. Parsons one Adolph Fischer one George Engel one Louis Lingg one William Seliger one Rudolph Schnaubelt and one Oscar W. Neebe, each late of the county of Cook, then and there feloniously, unlawfully, wilfully, and of their malice aforethought, not being present aiding, abetting and assisting, had advised, encouraged, aided and abetted the said certain person, a further description of whom is to the said jurors unknown, the perpetration of the crime aforesaid, and so the jurors aforesaid, upon then oaths aforesaid, do say that the said certain person, a further description of whom is to the said jurors unknown, the said August Spies the said Michael Schwab the said Samuel Fielden the said Albert R. Degan, then and there unlawfully, wilfully, feloniously and of his malice aforethought, did discharge and shoot off to, against, towards and upon the said Matthias J. Degan, and that the said August Spies, with one of the leaden bullets aforesaid, out of the pistol aforesaid, then and there by force of the gunpowder aforesaid, by the said August Spies discharged and shot off as aforesaid, then and there unlawfully, wilfully, feloniously and of his malice aforethought did strike, penetrate and wound him, the said Matthias J. Degan, in and upon the left thigh of him, the said Matthias J. Degan, giving to him, the said Matthias J. Parsons one Adolph Fischer one George Engel one Louis Lingg one Rudolph Schnaubelt and one Oscar W. Neebe, each late of the county of Cook, then and there feloniously, unlawfully, wilfully and of their malice aforethought, did stand by and aid, abet and assist the said William Seliger the perpetration of the crime aforesaid, and so the jurors aforesaid, upon their oaths aforesaid, do say that the said August Spies the said Michael Schwab the said Samuel Fielden the said Albert R. Parsons the said Adolph Fischer the said George Engel the said Louis Lingg the said William Seliger the said Rudolph Schnaubelt and the said Oscar W. Neebe him the said Matthias J. Degan, in manner and form aforesaid, unlawfully, wilfully, feloniously and of their malice aforethought, did kill and murder, contrary to the statute, and against the peace and dignity of the same People of the State of Illinois.

The Grand Jurors aforesaid, chosen, selected and sworn, in and for the county of Cook, in the State of Illinois, in the name and by the authority of the People of the State of Illinois, upon their oaths aforesaid, do further present that one Rudolph Schnaubelt, late of the county of Cook, on the fourth day of May, in the year of our Lord one thousand eight hundred and eighty-six, in said county of Cook, in the State of Illinois aforesaid, in and upon the body of one Matthias J. Degan, in the peace of the said People of the said State of Illinois then and there being, unlawfully, wilfully, feloniously and of his malice aforethought, did make an assault, and that he the said Rudolph Schnaubelt with a certain pistol, commonly called revolver, then and there charged with gunpowder and divers leaden bullets, which said pistol he, the said Rudolph Schnaubelt, then and there in his right hand had and held him the said Matthias J. Degan, in and upon the left thigh of him, the said Matthias J. Degan, then and there unlawfully, wilfully, feloniously and of his malice aforethought, did discharge and shoot off to, against, towards and upon the said Mathias J. Degan, and that the said Rudolph Schnaubelt with one of the leaden bullets aforesaid, out of the pistol aforesaid, then and there by force of the gunpowder aforesaid, by the said Rudolph Schnaubelt discharged and shot off as aforesaid, then and there unlawfully, wilfully, feloniously and of his malice aforethought did strike, penetrate and wound him, the said Matthias J. Degan, in and upon the left thigh of him, the said Matthias J. Degan, giving to him, the said Matthias J. Degan, then and there with the leaden bullet aforesaid, so as aforesaid discharged and shot out of the pistol aforesaid by the said Rudolph Schnaubelt, in and upon the left thigh of him, the said Matthias J. Degan, one mortal wound, contusion and laceration, of the depth of four inches and of the breadth of one inch, of which said mortal wound, contusion and laceration he, the said Matthias J. The Grand Jurors aforesaid, chosen, selected and sworn, in and for the county of Cook in the State of Illinois, in the name and by the authority of the People of the State of Illinois, upon their oaths aforesaid, do further present that one Louis Lingg, late of the county of Cook, on the fourth day of May, in the year of our Lord one thousand eight hundred and eighty-six, in said county of Cook, in the State of Illinois aforesaid, in and upon the body of one Matthias J. Degan, in the peace of the said People of the said State of Illinois then and there being, unlawfully, wilfully, feloniously and of his malice aforethought, did make an assault, and that he, the said Louis Lingg, with a certain pistol, commonly called revoiver, then and there charged with gunpowder and divers leaden bullets, which said pistol he, the said Louis Lingg, then and there in his right hand had and held him, the said Matthias J. Degan, in and upon the left thigh of him, the said Matthias J. Degan, then and there unlawfully, wilfully, feloniously and of his malice aforethought, did discharge and shoot off to, against, towards and upon the said Matthias J. Degan, and that the said Louis Lingg with one of the leaden bullets aforesaid, out of the pistol aforesaid, then and there by force of the gunpowder aforesaid, by the said Louis Lingg discharged and shot off as aforesaid, then and there unlawfully, wilfully, feloniously and of his malice aforethought did strike, penetrate and wound him, the said Matthias J. Degan, in and upon the left thigh of him, the said Matthias J. Degan, giving to him, the said Matthias J. Degan, then and there with the leaden bullet aforesaid, so as aforesaid discharged and shot out of the pistol aforesaid by the said Louis Lingg in and upon the left thigh of him, the said Matthias J. Degan, one mortal wound, contusion and laceration, of the depth of four inches and of the breadth of one inch, of which said mortal wound, contusion and laceration he, the said Matthias J. Degan, from the said fourth day of May, in the year aforesaid, until afterwards, to wit, on the same fourth day of May, in the same year, languished and languishing did live, on which said fourth day of May, in the same year, in the county and state aforesaid, he, the said Matthias J. Degan, of the said mortal wound, contusion and laceration died, and that one August Spies one Michael Schwab one Samuel Fielden one Albert R. Parsons one Adolph Fischer one George Engel one William Seliger one Rudolph Schnaubelt and one Oscar W. Neebe each late of the county of Cook, then and there feloniously, unlawfully, wilfully and of their malice aforethought, not being present alding, abetting and assisting, had advised, encouraged, aided and abetted the said Louis Lingg the perpetration of the crime aforesaid, and so the jurors aforesaid, upon their oaths aforesaid, do say that the said August Spies the said Michael Schwab the said Samuel Fielden the said Albert R. Parsons the said Adolph Fischer the said George Engel the said Louis Lingg the said William Seliger the said Rudolph Schnaubelt and the said Oscar W. Neebe, him, the said Matthias J. Degan, in manner and form aforesaid, unlawfully, wilfully, feloniously and of their malice aforethought, did kill and murder, contrary to the statute, and against the peace and dignity of the same People of the State of Illinois.

Degan, in the peace of the said People of the said State of Illinois then and there being, unlawfully, wilfully, felontously and of his malice aforethought did make an assault, and that he the said William Seliger, with a certain pistol, commonly called revolver, then and there charged with gunpowder and divers leaden bullets, which said pistol he the said William Seliger then and there in his right hand had and held him the said Matthias J. Degan, in and upon the left thigh of him the said Matthias J. Degan, then and there unlawfully, wilfully, feloniously and of his malice aforethought did discharge and shoot off to, against, towards and upon the said Matthias J. Degan, and that the said William Sellger, with one of the leaden bullets aforesaid, out of the pistol aforesaid, then and there by force of the gunpowder aforesaid, by the said William Seliger discharged and shot off as aforesaid, then and there unlawfully, wilfully, feloniously and of his malice aforethought did strike, penetrate and wound him, the said Matthias J. Degan, in and upon the left thigh of him the said Matthias J. Degan, giving to him, the said Matthias J. Degan, then and there with the leaden bullet aforesaid, so as aforesaid discharged and shot out of the pistol aforesaid by the said William Seliger, in and upon the left thigh of him the said Matthias J. Degan, in the peace of the said People of the said State of Illinois then and there being, unlawfully, wilfully, feloniously and of his malice aforethought, did make an assault, and that he the said Rudolph Schnaubelt with a certain pistol, commonly called revolver, then and there charged with gunpowder and divers leaden bullets, which said pistol he, the said Rudolph Schnaubelt. then and there in his right hand had and held him the said Matthias J. Degan, in and upon the left thigh of him, the said Matthias J. Degan, then and there giving to him, the said Matthias J. Degan, with the fragments aforesaid, in and upon divers parts of the head, left thigh, limbs and body of him, the said Matthias J. Degan, divers mortal wounds, bruises, lacerations and contusions, of which said mortal wounds bruises, lacerations and contusions he, the said Matthias J. Degan from the said fourth day of May, in the year aforesaid, until afterwards, to wit, on the same fourth day of May, in the same year, languished and languishing did live, on which said fourth day of May, in the same year, in the county and state aforesaid, he, the said Matthias J. Degan, in the peace of the said People of the State of Illinois then and there being, unlawfully, wilfully, feloniously and of his malice aforethought, did make an assault, and that he, the said Louis Lingg, with certain means, instruments and weapons, a more particular description of which is to the said jurors unknown, unlawfully, wilfully, feloniously and of his malice aforethought did strike, lacerate, penetrate and wound the body and limbs of the said Matthias J. Degan, then and there giving to him, the said Matthias J. Degan, with the means, instruments and weapons aforesaid in and upon divers parts of the head, left thigh, limbs and body of him, the said Matthias J. Degan, divers mortal wounds, bruises, lacerations and contusions, of which said mortal wounds, bruises, lacerations and contusions he, the said Matthias J. Degan from the said fourth day of May, in the year aforesaid, until afterwards, to wit, on the same fourth day of May, in the same year, languished and languishing did live, on which said fourth day of May, in the same year, in the county and state aforesaid, he, the said Matthias J. Degan, of the said mortal wounds, contusions and lacerations died, and that one August Spies one Michael Schwab Samuel Fielden one Albert R. Parsons one Adolph Fischer one George Engel one William Seliger one Rudolph Schnaubelt and one Oscar W. Neebe, each late of the county of Cook, then and there feloniously, unlawfully, wilfully, and of their malice aforethought, did stand by and aid, abet and assist the said Louis Lingg in the perpetration of the crime aforesaid, and so the jurors aforesaid, upon their oaths aforesaid, do say that the said August Spies the said Michael Schwab the said Samuel Fielden the said Albert R. Parsons the said Adolph Fischer the said George Engel the said Louis Lingg the said William Seliger the said Rudolph Schnaubelt and the said Oscar W. Neebe him, the said Matthias J. Parsons one Adolph Fischer one George Engel one William Seliger one Rudolph Schnaubelt and one Oscar W. Neebe, each late of the county of Cook, then and there feloniously, unlawfully, wilfully, and of their malice aforethought, not being present aiding, abetting and assisting, had advised, encouraged, aided and abetted the said Louis Lingg in the perpetration of the crime aforesaid, and so the jurors aforesaid, upon their oaths aforesaid, do say that the said August Spies the said Michael Schwab the said Samuel Fielden the said Albert R. Parsons the said Adolph Fischer the said George Engel the said Louis Lingg the said William Seliger the said Rudolph Schnaubelt and the said Oscar W. Neebe him, the said Matthias J. Degan, in manner and form aforesaid, unlawfully, wilfully, feloniously and of their malice aforethought, did kill and murder, contrary to the statute, and against the peace and dignity of the same People of the State of Illinois.

The Grand Jurors aforesaid, chosen, selected and sworn, in and for the county of Cook, in the State of Illinois, in the name and by the authority of the People of the State of Illinois, upon their oaths aforesaid, do further present that one William Seliger, late of the county of Cook, on the fourth day of May, in the year of our Lord one thousand eight hundred and eighty-six, in said county of Cook, in the State of Illinois aforesaid, in and upon the body of one Matthias J. Degan, in the peace of the said People of the State of Illinois then and there being, unlawfully, wilfully, feloniously and of his malice aforethought, did make an assault, and that he, the said William Seliger, with certain means, instruments and weapons, a more particular description of which is to the said jurors unknown, unlawfully, wilfully, feloniously and of his malice aforethought, did strike, lacerate, penetrate and wound the body and limbs of the said Matthias J. Degan, then and there giving to him, the said Matthias J. Degan, with the means, instruments and weapons aforesaid, in and upon upon divers parts of the head, left thigh, limbs and body of him, the said Matthias J. Degan, divers mortal wounds, bruises, lacerations and contusions, of which said mortal wounds, bruises, lacerations and contusions he, the said Matthias J. Degan, from the said fourth day of May, in the year aforesaid, until afterwards, to wit, on the same fourth day of May, in the same year, languished and languishing, did live, on which said fourth day of May, in the same year, in the county and state aforesaid, he, the said Matthias J. Degan, of the said mortal wounds, contusions and lacerations died, and that one August Spies one Michael Schwab one Samuel Fielden one Albert R. Parsons one Adolph Fischer one George Engel one Louis Lingg one Rudolph Schnaubelt and one Oscar W. And afterwards to wit: On the fifth day of June in the year last aforesaid, it being the term of Court last aforesaid the following among other proceedings, were had and entered of record in said Court, which said proceedings are in the words and figures following to wit:

18803 Indictment for Murder

This day come the said People by Julius S.Grinnell States Attorney and the said defendants as well in their own proper persons as by Salomon and Zeisler, W.P. Black and W.A. Foster their Counsel also come, and they having been furnished with copies of the Indictment in this cause and lists of the names of the witnesses and Jurors, and they being now here severally duly arraigned and forthwith demanded of and concerning the crime alleged against them in said Indictment how they will acquit themselves thereof for a plea in that behalf severally say, that they are Not Guilty in manner and form as charged therein and of this they put themselves upon the Country and the said People do the like.

Thereupon it is ordered that the said defendants, August
